These Terms of Service (“Terms”) govern your access to and use of tayampeptide.com and related services provided by WINKEY TECHNOLOGY USA INC, doing business as TAYAM (“TAYAM,” “we,” “us,” or “our”). By visiting the site, placing an order, or otherwise using the services (collectively, the “Services”), you agree to these Terms and the policies referenced in them.

If you do not agree to these Terms, do not use the Services.

1. Eligibility and customer responsibility

You must be at least the age of majority where you live, or use the Services with the permission and supervision of a parent or legal guardian who agrees to these Terms. You are responsible for providing accurate, current, and complete information and for maintaining the confidentiality of any customer account credentials.

2. Online store platform

Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and Services to you. Your use of certain features may also be subject to Shopify’s applicable terms and privacy notices.

3. Product information

We make reasonable efforts to describe and display products accurately. Colors, packaging, ingredients, product appearance, and other details may vary because of device settings, manufacturing updates, or other factors. We may update product descriptions, packaging, ingredients, availability, and prices without prior notice.

Products are intended for cosmetic use as directed. Product descriptions, educational materials, and customer-service communications are not medical advice and are not intended to diagnose, treat, cure, or prevent any disease. Individual results and skin responses vary. Stop use if persistent irritation or an unexpected reaction occurs, and consult a qualified medical professional when appropriate.

4. Orders and acceptance

An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may accept, limit, cancel, or refuse an order for reasons including product availability, pricing or description errors, suspected fraud, unauthorized resale, shipping restrictions, payment issues, or policy abuse.

If we cancel an order after payment has been processed, we will issue an appropriate refund to the original payment method.

5. Prices, payment, and taxes

Prices are displayed in U.S. dollars unless otherwise stated. Prices, promotions, and availability may change without notice. Applicable taxes, shipping charges, and discounts are calculated and displayed during checkout.

You represent that you are authorized to use the payment method submitted with an order. Payment services are provided by third-party payment processors and may be subject to their terms.

6. Shipping

We currently ship within the United States, subject to destination and service availability. Shipping rates, processing times, delivery estimates, tracking, address issues, and delivery claims are governed by our Shipping Policy, which is incorporated into these Terms.

Delivery dates are estimates and may be affected by carriers, weather, address problems, demand, and other circumstances outside our reasonable control.

7. Returns and refunds

Returns, refunds, damaged or incorrect items, sets, gifts, non-returnable products, and related matters are governed by our Returns & Refunds Policy, which is incorporated into these Terms.

8. Marketing communications

If you subscribe to marketing emails, you agree that we may send product news, peptide-science content, and brand updates. You can unsubscribe at any time using the link in an email. Transactional or service-related communications may still be sent when needed to manage an order, account, safety matter, or customer-service request.

9. Intellectual property

The Services and their content—including trademarks, logos, product names, text, photographs, graphics, videos, design, and software—are owned by or licensed to TAYAM and are protected by intellectual-property laws. These Terms give you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Services for lawful, non-commercial purposes.

10. Reviews and other submissions

If you submit a review, photograph, comment, idea, or other content, you represent that you have the right to provide it and that it is accurate, lawful, and does not violate another person’s rights. You grant TAYAM a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify, publish, translate, distribute, and display that content in connection with the Services and our business, subject to applicable law and our Privacy Policy.

We may moderate or remove submissions that are unlawful, misleading, abusive, infringing, unrelated, or otherwise inappropriate. We are not obligated to publish or retain any submission.

11. Prohibited uses

You may not use the Services to:

• Engage in fraud, deception, unauthorized resale, or policy abuse.
• Transmit malicious code or interfere with the security or operation of the Services.

15. Limitation of liability

To the fullest extent permitted by law, TAYAM and its directors, officers, employees, affiliates, agents, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity arising from or related to the Services or products.

To the fullest extent permitted by law, our aggregate liability for a claim relating to a purchased product will not exceed the amount you paid for the product giving rise to the claim. These limitations do not apply where prohibited by law or to liability that cannot legally be limited.

16. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless TAYAM and its affiliates, directors, officers, employees, agents, contractors, licensors, and service providers from third-party claims, losses, liabilities, and reasonable costs arising from your unlawful use of the Services, your violation of these Terms, or your violation of another person’s rights.

We may suspend or terminate access to the Services when we reasonably believe these Terms, applicable law, security, or the rights of others have been violated. Provisions that by their nature should survive termination will remain in effect.

18. Changes to the Services or Terms

We may update the Services and these Terms from time to time. Revised Terms become effective when posted unless a later date is stated. Your continued use of the Services after the effective date constitutes acceptance of the revised Terms.

19. Governing law and venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Subject to any non-waivable consumer rights, legal proceedings arising from these Terms or the Services will be brought in the state or federal courts located in Orange County, California, and the parties consent to their jurisdiction and venue.

20. General terms

If a provision of these Terms is held invalid or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent. We may assign them as part of a corporate transaction or business reorganization.
